SUBJECT: REVISION OF ORDINARY FAMILY PENSION IN RESPECT OF PRE-96 DECEASED ARMED FORCES PERSONNEL BELOW OFFICER RANK(PBOR)
Sir,
I am directed to say that consequent on issue of this Ministry's letter Nol(1)/99/D/(PEN/SERVICES) dated 7.6.99 as amended by corrigendum dated 23.6.99. on modified parity with effect from 1.1.96. family pension of all Armed Forces pensioners irrespective of the date of retirement/discharge/invalidment shall not be less than 30% of the minimum pay (including classification allowance) in the revised scale of pay introduced w.e..f. 1.1.96 of the rank and group last held by the pensioner deceased individual. As the revision of ordinary family pension in respect of those family pensioners of PBOR in receipt of family pension @ Rs 1275 PM with effect from 1.1.96 will not be beneficial, no revision is involved under these modified orders. In other cases of family pension, revision is however involved .
2. Under this Ministry's letter dated 7.6.99 and Corrigendum dated 23.6.99, the revision of family pension is required to be done by the PSA concerned on the receipt of the application from record office concerned through PDA after fixation of notional pay. In pre 1.1.86 cases. As there has been representation from various agencies for prompt revision of family pension, the President is pleased to decide that PDAs shall refix ordinary family pension w.e.f. 1.1.96 in respect of family pensioners belonging to armed forces Personnel Below Officer Rank (PBOR) without any further authorisation from concerned PSA and shall pay the arrears on account of such refixation irrespective of the fact wheather the family pensioner has submitted application or not under this ministry's letter dated 14.7.98.
3. With a view to expediting the refixation of ordinary family pension by the PDA, a table showing the rate of ordinary family pension calculated at 30% of the minimum pay including classification allowance, if any, in revised scale introduced w.e.f. 1.1.96 is appended with this letter as Annexure-A for Army Personnel, Annexure-B for Navy Personnel and Annexure-C for Air Force Personnel which indicate the rates of ordinary family pension for different ranks and groups as admissible with effect from 1.1.96 irrespective of date of retirement/death.
4. Where a family pensioner is drawing consolidated rate of family pension in terms of this Ministry's letter dated 24.11.97 which happens to be more than the amount shown in the tab le, her family pension shall not be revised to the disadvantage of family pensioner. However subsequently on receipt of application if the ordinary family pension is found to be more than 30% of the minimum pay in the revised scale introduced w.e.f. 1.1.96, the same shall be revised by the PSA concerned.
5. Where the group of the pensioner is not indicated in the PPO, pension may be revised as per the scales of the lowest group of the rank. In these cases the PDAs should address the concerned RO to ascertain the group of the deceased soldier. On receipt of the requisite information, pension may be further revised as due.
6. This issues with the concurrence of Defence (Finance /Pension) vide their U.O No. 615 /pen/99 dated 4.10.99.
