Subject : - Revival of anomaly in pension revision of Havaldars (granted Honorary rank of Nb Sub) under 5th Pay Commission recommendations.
Sir,
As per Regulation 137 Pension Regulations for the Army 1961(part-1), Hav. Who are granted Hony rank of Nb/Sub on retirement are entitled to an additional pension at the rate prescribed from time to time .The rate was revised from Rs.45/- p.m. to Rs.100/- p.m. w.e.f. 01.10.1991.Consequently on the issue of orders for consolidation of pension under 5th CPC vide Govt. of India, Min. of Defence letter no. 1(2)/97/d/ (Pen/Sers) dt. 24.11.97, the additional pension was taken as Rs.100/- p.m. for those pre-96 retirees who retired on or after 01.10.91. For pre-96 retirees who retired prior to this date the additional pension for the rank of Hony Nb/Sub continued to be Rs.45/- p.m. However, with the issue of Govt. letter no.1 (2)/98/d (Pen/Sers) dt.14.07.98 service pension of all the pre-86 retirees was brought at par to those who retired on of after 01.01.86.While doing this, concordance tables provided in the aforesaid Govt. letter dt.14.07.98, took into the account the additional pension of Rs.100/- p.m. for Hony Nb/Sub although this rate was applicable only w.e.f. 01.10.91.This created an anomalous situation. In the case of that Hony Nb/Sub who retired between 01.01.86 and 30.09.91, the rate of additional pension for consolidation purposes was being taken as Rs.45/- under the Govt. letter dt.24.11.97.However for Hony Nb/Sub retiring prior to 01.01.86, the rate of additional pension of rs.100/- had been taken under Govt. letter dt.14.07.98 as stated above.
2. The removal of this anomaly has been under consideration of the Govt. for some time. The President is now pleased to decide that for consolidation of pension of Pre-96 retirees under Govt. letter dt.24.11.97,the rate of additional pension for the rank of Nb/Sub under Reg. 137 PRA Pt.i(1961), shall be taken as Rs.100/-p.m. as in the case of pre-86 retirees.
3. This issue with the occurrence of Min. of Defence(Fin) vide their UO No.1614/ Pen/02 dt.12.06.2002.
