GENERAL GUIDELINES:
Implementation
of its provisions regarding revision of various elements of pension may be done
keeping in view the following general guidelines:-
(i)
APPLICABILITY
These
orders are applicable to all Pre-96 Armed Forces Family/Disability/War Injury
Pensioners who were/are in receipt of Special Family Pension/Liberalised Family
Pension /Dependant/Disability/War Injury Pension as on 1.1.96.
(ii)
NON
APPLICABILITYThe provisions
of this letter do not apply in the following cases: -
(a)
Gallantry Awards,
such as Param Vir Chakra, Ashok Chakra etc. Amount of Gallantry Awards
sanctioned or notified either separately or with special family
pension/liberalized family pension will not be taken into account for revision
of SFP/LFP under these orders.
(b)
UK/HKSRA pensioners/family pensioners.
(c)
KCIOs who are in receipt of pension in Pound or Sterling as on 1.1.96.
(d)
Persons in receipt of Compassionate Allowance/Guzara/ Reservists
Allowance or any other allowance on which relief is not payable.
(e)
Ex-gratia family pension @Rs.150/- pm to the families of the deceased
reservist covered by Govt. of India, Min. of Defence order No. 1(7)/92/D(Pen/Sers)
dt. 30.3.92 revised to Rs.605/- pm w.e.f 1.11.97 under MOD Letter No.
B/40029/AG/PS-4(d)/1/B/D (Pen/Sers) dt. 7.1.99.
(f)
Families of Artificers Skilled Non-Combatants (Enrolled) of the Corps of
EME who are in receipt of Rs.150/-pm as Ex-Gratia payment w.e.f 1.1.92.
g)
Family pensioners of Armed Forces Pensioners who are in receipt of
ordinary family pension.
(iii)
DUE/DRAWN STATEMENTS
All the payments already made beyond 1.1.96 shall be adjusted by preparing due
and drawn statements. A suitable
entry regarding revised special family pension/Liberalised family
pension/disability pension should be made in check register/payment register/
pension payment scroll/pension certificate etc.
(iv)
OVER PAYMENTS/RECOVERY OF
From the arrears payable under this Govt. letter dt. 16.5.2001, PDA should
deduct any overpayment already detected or under process of recovery.
(v)
LIFE TIME ARREARS (LTA)
Where a pre-96 special family
pensioner, Liberalized family pensioner, disability pensioner was alive on
1.1.96 but died on or after 1.1.96 life time arrears payable to the heir will be
revised in terms of these orders and paid to the legal/nominated heir. For
detailed instructions in this regard please refer to para 21.1 of Government of
India, Ministry of Defence letter dated 14-7-98 (circulated under our letter No.
Gts/Tech/0162-IX dated 13-8-98).
(vi)
NO REVISION WHERE PRE-REVISED PENSION IS MORE BENEFICIAL
In cases where pension has been
finally sanctioned under the pre-revised orders and if it happens to
be more beneficial than the pension becoming due under these orders, the pension
already sanctioned shall not be
revised to the disadvantage of the pensioners.
(vii)
ELEMENTS TO BE REVISED BY PDAs
(a)
Special Family Pension (Para 2 of GOI letter dt. 16.5.2001).
(b)
Dependent Pension (Para 3 of GOI letter dt. 16.5.2001).
(c)
Dependent Pension (Liberalised) (Para 4 of GOI letter dt. 16.5.2001).
(d)
Liberalised Family Pension (LFP) (Para 5 of GOI letter dt. 16.5.2001).
(e)
Disability Pension (Para 6 of GOI letter dt. 16.5.2001).
(f)
Constant Attendance Allowance (Para 9 of GOI letter dt. 16.5.2001).
(viii)
ELEMENTS NOT TO BE REVISED BY PDAs
(a)
War Injury Pension (Para 7 & 8 of GOI letter dt. 16.5.2001).
(b)
Special Family Pension/Liberalized Family Pension on remarriage of widow
(Para 10 of GOI letter dt. 16.5.2001).
(c)
Second life award (special family pension) and second life award
(liberalized family pension)
(ix)
SUO-MOTO REVISION
The Pension Disbursing Agencies may take action to revise the pension in
respect of the elements indicated in (vii) above, suo-moto, without waiting for
any application from the pensioners and without reference to this office.
3.
GUIDELINES FOR REVISION OF SPECIFIC ELEMENTS:
(i) SPECIAL
FAMILY PENSION IN RESPECT OF PBOR AND
COMMISSIONED OFFICERS
In
the first instance, special family pension will be consolidated in terms of GOI,
MOD letter No. 1(2)/97/D(Pen/Sers) dt. 24.11.97 (circulated under our circular
No. Gts/Tech/0162-III) dt. 23.12.97). The Special Family Pension, so
consolidated, irrespective of the date of the award shall not be less than 60%
of the minimum pay in the revised scale of pay introduced w.e.f 1.1.96 of the
rank (in the case of commissioned officers), rank and group (in the case of PBOR)
held by the deceased at the time of death subject to the minimum of Rs.2550/-pm.
Table 1and Table 2
give the minimum pay
for different ranks of Commissioned Officers and the corresponding values of Spl.
Family pension. The corresponding tables in respect of PBORs are table
3 , table
4 and table 5 .
(ii) DEPENDANT PENSION (COMMISSIONED OFFICERS ONLY)
In case of pensioners in receipt of Dependant pension as on 1.1.96,
pension will be consolidated in terms of GOI, MOD letter No. 1(2)//97/D(Pen/Sers)
dt. 24.11.97. However, dependant pension so consolidated irrespective of the
date of award, shall not be less than 50% of the special family pension worked
out on the minimum pay in the revised scale of pay introduced w.e.f 1.1.96 of
the rank held by the deceased Officer at the time of death subject to
a minimum
of Rs.1275/-pm. Please see Table 1 and Table
2
(iii)
LIBERALISED
FAMILY PENSION (LFP) (APPLICABLE BOTH FOR PBOR AND COMMISSIONED OFFICERS)
In the case of the pensioners in receipt of Liberalised Family Pension as
on 1.1.96, pension will be consolidated in terms of GOI, MOD letter No. 1(2)/97/D(Pen/Sers)
dt. 24.11.97. However, the liberalized family pension, so consolidated,
irrespective of the date of award shall not be less than the reckonable
emoluments calculated on the minimum pay in the revised scale of pay introduced
w.e.f 1.1.96 of the rank (in case of Commissioned Officer), rank and group (in
case of PBOR) held by the deceased at the time of death. Please see Tables 1 and
2 in
respect of Commissioned Officers and
table 3 , table
4 and table 5
in respect of PBOR.
Note
: Minimum revised pay and
classification allowance with effect from 1.1.96 for PBOR are given in
Annexure
A ,Annexure B & Annexure C
of this Circular.
(iv)
DEPENDANT
PENSION (LIBERALISED) (APPLICABLE TO COMMISSIONED OFFICERS ONLY)
In case of pensioners in receipt of Dependant Pension (Liberalised) as on
1.1.96, pension will be consolidated in terms of GOI, MOD letter No. 1(2)/97/D(Pen/Sers)
dt. 24.11.97. However, the Dependant pension (Liberalised) so consolidated,
irrespective of the date of award shall not be less than 75% (in case both
parents are alive) and 60% (in case of single parent/Dependant brother (s) and
sister (s)) of the Liberalised Family Pension worked out on the minimum pay in
the revised scale of pay introduced w.e.f 1.1.96 of the rank held by the
deceased Officer at the time of death. Please see Tables
1 and Table 2.
(v)
DISABILITY PENSION
For
pensioners in receipt of disability pension as on 1.1.96, w.e.f 1.1.96 the rates
of disability element for 100% disability in non-battle casualty
cases shall be

Where
the disability of a pensioner is less than 100% but not less than 20%, the rates
of disability element shall be proportionately reduced.
Concordance table showing existing rates and revised rates of disability
element for various ranks and different percentages is given in Table No. 6.
Note
1: Special Family Pension in respect of PBOR has been notified under 'F'
series of PPO w.e.f 1951. Prior to this, Special Family Pension was notified
through Pension Circular wherein the nature of family pension was indicated.
Liberalised Family Pension in respect of PBOR has been notified under
"F/BC" series of PPOs (Ordinary family pension notified under F/NA
series of PPOs should not be revised in terms of these orders).
In
the case of Commissioned Officers, Special Family Pension/ Liberalised Family
Pension has been notified under "M", and "M/F" series of
PPOs and dependant pension under "M/ Dep" series of PPOs. However, the
nature of pension has also been clearly indicated in the body of the PPOs.
Note
2: In
the case of PBOR where pay group is not available in the PPO/PC/Descriptive roll
and discharge certificate of the deceased, it may be called for from the
concerned Record Office. The letter from the Record Office, intimating the group
of the pensioners, should be attached with the PPO for future reference. Pending
receipt of the information regarding the group of the pensioner, his/her pension
may be provisionally revised assuming the pensioners to belong to the lowest
group (i.e. Group E). On receipt of information regarding the correct group from
the Record Office, the pension should be suitably revised.
List
of addresses of all the Record Offices are available in the Annexure to Govt. of
India, Ministry of Defence letter dt. 14.7.98.
Note
3:
Existing
special family pension/liberalised family pension, dependant pension (Liberalised)
and Dependant Pension being drawn by the family pensioners w.e.f 1.1.96 might
have already been consolidated by the PDAs in terms of G of I. MOD letter dt.
24.11.97 under reference.
Disability pension in respect of pensioners retired between 1.1.86 and
31.12.95 is supposed to have been revised taking into account the service
element and disability element in terms of Govt. letter dt. 24.11.97. As a
result of issue of the Govt. letter dt. 16.5.2001, service element will be
exclusively revised in terms of para 4.1.1 of Govt. letter dt. 24.11.97 and
disability element will be revised in terms of para 6 of the Govt. letter dated
16.5.2001 (Table No. 6) and both the elements will be added to arrive at
disability pension payable w.e.f. 1.1.96. The new rates of D.A. shall be payable
on total of both elements taken together.
In the case of Pre 86 pensioners, the service element of PBOR is supposed
to have been revised as per the tables provided with the Govt. letter dated
14.7.98. In their cases their disability element payable w.e.f. 1.1.96 will be
revised as per Para 6 of the Govt. letter dated 16.5.2001 (Table No. 6) and new
rates of D.A. shall be payable on total of both the elements.
As
regards Commissioned Officers, the service element of disability pension has
already been revised by issue of Corrg. PPOs by this office. In their cases,
their existing disability element payable w.e.f. 1.1.96 onwards may be revised
as per Para 6 of the Govt. letter dated 16.5.2001 (Table No. 6) and new rates of
D.A. shall be payable on both the elements taken together.
Model
examples for revision of disability pension are given in Annexure E
(in respect of
Commissioned Officers
:
Post ’86-Pre ‘96
& Pre'86 and
PBOR
:
Pre ’86 &
Post ’86-Pre ‘96.) pensioners
If
these consolidations/revisions have already been carried out, no further
consolidation is required to be done by the PDAs at this stage.
Note
4:
In case of
special family pension/liberalised family pension, where the pension has been
divided between two or more eligible members of the family, revised special
family pension/liberalised family pension worked out as above shall be divided
in the same ratio in which it was initially divided.
Note
5:
While
revising Dependant Pension it should be ascertained from the PPO as to whether
it was sanctioned for single parent or for both parents. The corresponding rate
of Dependant Pension should be taken from the relevant columns of Table 1 and
Table
2.
Note
6:
The amount of disability element already commuted out of pre-revised
disability element should be deducted from the revised disability element till
restoration of commuted portion of pension.
(vi)
CONSTANT ATTENDANCE ALLOWANCE
With effect from 1.1.96, Constant Attendance Allowance, in all eligible
battle/non battle casualty cases shall be paid at the revised rate of Rs.600/-
pm irrespective of the rank.
(vii)
DEARNESS
RELIEF
Dearness
Relief shall be admissible on the revised rates commencing from 1.7.96 at the
rates sanctioned from time to time vide Ministry of Personnel, Public Grievances
and Pension (Deptt. of Pension and Pensioners' Welfare) Office memorandum No.
42/2/97-P&PW (G) dt. 27.10.97. While calculating dearness relief on
disability pension, service element and disability element, both will be taken
together.
4.
CASES TO BE REFERRED TO OTHER AUTHORITIES
(i)
WAR INJURY PENSION
(Mentioned
in paras 7 & 8 of Govt. letter dt. 16.5.2001)
The PDA should not revise the cases of this nature but should refer such
cases to the Record office in the case of PBOR. However, in the case of
Commissioned officers such cases should be sent to the authorities as indicated
below:
(a)
Pr.CDA (P) Allahabad:
a)
Cases pertaining to Commissioned officers of the Army.
b)
Cases pertaining to the Commissioned officers of the Navy who died in
service or who retired prior to 1.11.85 and in whose case the pension being
revised was notified by Pr. CDA(P).
c) c)
Cases pertaining to the Commissioned officers of the Air force who died
in service or who retired prior to 1.11.85 and in whose case the pension being
revised was notified by Pr. CDA(P).
(b)
CDA (Navy), Mumbai:
Cases
pertaining to the Commissioned Officer of the Navy who died in service or who
retired on or after 1.11.85.
(c)
CDA (AF), New Delhi
Cases
pertaining to the Commissioned Officers of the Air Force who died in service or
who retired on or after 1.11.85.
(ii)
RESTORATION OF SPECIAL FAMILY PENSION/ LIBERALISED FAMILY PENSION ON
REMARRIAGE OF WIDOW
Widows in
receipt of Special Family Pension/Liberalised Family Pension who re-marry on or
after 1.1.1996 can now apply for restoration of their pension.
The
Pension Disbursing Agencies should not regulate such cases themselves but advise
the widow to apply to the Record Office (in case of widow of PBOR) along with
details of
(i) late husband name and original PPO No. & year,
(ii) The PPO
No. and year granting Special Family Pension/Liberalised Family Pension to the
widow,
(iii) The PDA from which pension was last drawn
(iv) Date of re-marriage
and the date from which pension was stopped
(v) Details of children from
previous marriage, and whether the widow continues to support the children.
The
certificate regarding supporting/non-supporting of children should be
countersigned by the Zila Sainik Board or by any of the authorities mentioned in
Para 9 of the Pension Payment Instructions (extract enclosed).
In
the case of widows of Commissioned Officers, the widow should apply, along with
requisite information/certificate, to the relevant authority as mentioned in
sub-paras (I) to (III) of Para 4 (i) above.
(iii)
REVISION OF SECOND LIFE AWARD(SFP) AND SECOND LIFE AWARD (LFP) IN RESPECT
OF PBOR INCLUDING NCs(E).
The
Pension Disbursing Agencies should not regulate such awards themselves, but
advise the pensioners in receipt of second life Award (SFP or LFP) to apply to
the Record office concerned alongwith details of
(i) Name of
original receipting of FP and original PPO No. & year
(ii)
The PPO No. and year granting second life award of SFP/LFP to the
pensioner
(iii) The details of his/her PDA from which pension is being drawn.
(iv)
Calculation sheet (as per
specimen attached as Annexure- D) in respect of pension revised under these
orders may please be sent by name to Shri Jamuna Ram, Sr. AO, OI/C
Audit/Coordination Section of this office separately for further necessary
action.
(v)
In cases where the PDAs are in doubt regarding the revision in individual
cases, the concrete cases with full details of pensioners and PPO number may be
referred to this office viz OI/C
GI/Mily Section in case of Commissioned Officer and OI/C G-3 Section for
disability pension and OI/C G-4 Section for special family pension and
liberalised family pension of P.B.O.R. by name.

Please
refer to Para 4(ii) of this Circular regarding restoration/regulation of Special
Family Pension/Liberalized Family Pension of widows who re-marry or on after
1.1.1996. A wide publicity may please be given to this provision since in most
cases, pensions have already been stopped and it would be difficult for the
widows to know about this new rule. Advertisements in Newspapers, T.V. as well
as publicity through the Zila Sainik Boards may be required. Also the Zila
Sainik Boards may be instructed to countersign (after due investigation) the
widow’s certificate regarding support/non-support of minor children from the
first marriage. Necessary instructions may also be issued to the Record Offices
regarding processing of the widow’s claim (in case of PBOR) before onward
transmission to this office. Action taken in this regard may kindly be intimated
to this office.

case where PDA is not authorised to revise i.e. WIP,LFP/SFP, Second life cases,
re-marriage after 1.1.96, RO will initiate a claim with service documents for
revision to Pr. CDA(P) Allahabad or CDA(N) or DCDA (AF) as the case may be as
explained in Para 16 above.
