Revision of Pension Post86/Pre96 Pension/ Family Pension

Subject:- Implementation of Govt. decision on the recommendations of the Vth Central Pay Commission; Revision of pension of Post-1986/ Pre-1996  Service pensioners etc./ Ordinary family pensioners belonging to Armed Forces Commissioned Officers.

  5. CONSOLIDATION OF PENSION UNDER VTH CPC PRE 96 PENSIONERS

Applicability

The above Govt. letter is applicable to all Post-86/ Pre-96 pensioners/family pensioners who were in receipt of following types of pensions as on 01-01-1996.

(a)    Retiring Pension

(b)   Invalid Pension

(c)    Ordinary Family Pension

(d)   Service Element of Disability Pension

(e)    Service Element of War Injury Pay 

These orders apply to all the Armed Forces Commissioned Officers i.e. P.R.C., including M.N.S., E.C./S.S.C. and T.A. officers and officers of State forces and their N.O.Ks who were drawing pension/family pension as on 01-01-1996 under the Pension Regulations of the three Services/State Forces and various orders issued from time to time. 

Summary :- Under the above Govt. letter the existing Retiring pension/ Invalid pension/ Service element of Disability pension/ Service element of War Injury pension shall  be consolidated as per Govt. of India, Ministry of Defence letter no. 1/(2)/97/D(Pension/Services) dt. 24-11-1997 which will be the consolidated pension as on 01-01-1996 subject to the condition that the pension so consolidated shall not be less than 50% of the minimum pay in the revised scale of pay introduced w.e.f. 1-1-96 of the rank held by the pensioners as per Govt. of India, Ministry of Defence letter  dt. 7-6-99 cited above. The existing provision in the rule governing qualifying service and minimum pension shall continue to be operative. 

In cases where ordinary family pension has been granted at the rate less than 30% of pay last drawn by the pensioner/deceased officer the same shall be recalculated / consolidated as per provisions contained in Govt. letter dated 27-05-1998 and 24-11-1997 subject to the condition that the pension so consolidated shall in no case be less than 30% of the minimum pay in the revised scale introduced w.e.f. 1-1-1996 of the rank last held by the pensioner/ deceased officer as per Govt. letter dt. 7-6-1999 cited above.

Conditions

The Provisions of the above letter do not apply to the following categories:- 

      i.        Gallantry awradees-monetary allowance attached to the award, such as Param Vir Chakra, Ashok Chakra, etc.

     ii.        UK/HKSRA Pensioners

   iii.        KCIOs who were in receipt of pension in pound sterling as on 01-01-1996

   iv.        Persons in receipt of Disability element only.

Implementation

Under mentioned agencies are involved in implementation of above order for revision of pension: 

(a)                Pensioners/family pensioners

(b)               Pension Disbursing Authorities

(c)                Pension Sanctioning Authorities. 

METHOD OF IMPLIMENTATION BY :-

(a)                Pensioners : Pensioners/family Pensioners will apply to the PDA. For revision of ordinary Family pension as per application (Annexure-II). 

(b)               PDA: PDAs will verify the relevant entries shown in Col. 1 to 10 and forward the application to the PSA. 

(C)              Pr. CDA (P):

The Office of Principal CDA (P) on receipt of the application from Pension Disbursing Authority shall scrutinise the cases with reference to the original documents held in his office and issue corrigendum PPO revising the officer's pension/ ordinary family pension keeping in view the provisions contained in Govt. letters dt. 24-11-1997,  27-05-1998 & 07-06-1999.

CONSOLIDATION OF PENSION UNDER VTH CPC PRE 96 PENSIONERS

Subject :- Consolidation of pension w.e.f. 1-1-1996 by the P.D.A. (Table based) 

Authy:-  Govt.  of India, Ministry of Defence letter no. 1(2)/97/D (Pensions/Services) dt. 24-11-97 

Applicability :- It is applicable to all pre-96 pensioners/Family pensioners belonging to Armed Forces. 

Summary:- Under the above Govt. letter, pension of all the Pre 96 pensioners/family pensioners of the Armed Forces personnel has been revised/consolidated w.e.f. 1-1-96 with reference to the Table annexed to this letter.

The table has been prepared by adding together the following elements:- 

(a)                The existing pension/family Pension.

(b)               Dearness Relief up to CPI Index 1510 i.e. @ 148% @111% and @ 96% of Basic pension as admissible on 1-1-96 vide DP & PW OM No. 42/9/96 P&PW (9) dated 20-3-96.

(c)                Interim Relief I

(d)               Interim Relief II

(e)                Fitment Weightage @ 40% of the existing pension/family pension i.e. of (a) above.

 Note:   Where the amount of fitment weightage works out in fraction of a rupee, it will be rounded off to the next rupee.

 Conditions:- The Provisions of the above letter do not apply to the following categories:-

       i.        Gallantry awradees-monetary allowance attached to the award, such as Param Vir Chakra, Ashok Chakra, etc.

     ii.        UK/HKSRA Pensioners

   iii.        KCIOs who were in receipt of pension in pound sterling as on 01-01-1996

   iv.        Persons in receipt of Compassionate Allowance, Guzara, Reservist allowance or any other allowance on which relief is not admissible.

    v.        Ex-gratia family pension at Rs.150/- per month to the families of deceased reservists covered by Govt. of India, Min. of Defence Order No. 10(7)/92/D(Pens/Sers) dt. 30th March 1992.

   vi.        Persons in receipt of Disability element only.

(Separate orders will be issued in respect of (v) and (vi) above.)

 Implementation:- The consolidation of pension is to be done by the Pension Disbursing Authorities as per Annexure I of above govt. letter.
