DEFINITION OF PENSION

Pension shall include gratuity except when the term pension is used in contradistinction to gratuity but does not include dearness relief.

GRANT OF PENSION IS SUBJECT TO GOOD CONDUCT

Future good conduct shall be an implied condition for every kind of grant of pension.

          RETIRING PENSION

The minimum qualifying service to earn retiring pension is 20 Years and 15 Years in the case of late entrants without weightage and in respect of EC/S.S.C. officers 12 years including rank service if any (Without weightage).

DEFINITION OF LATE ENTRANTS

A late entrant is an officer who is released on reaching the prescribed age limit for compulsory retirement with at least 15 Years service (without weightage) qualifying for pension but whose actual qualifying service is less than 20 Years without weightage.

QUALIFYING SERVICE FOR PENSION

Actual qualifying service rendered by the officer plus a weightage (in years) appropriate to the last rank held as indicated below subject to total qualifying service including weightage not exceeding 33 Years.

RECKONABLE EMOLUMENTS FOR RETIRING PENSION

Reckonable emoluments consist of basic pay, Rank Pay, N.P.A. and stagnation increment if any.

CALCULATION OF RETIRING PENSION

Retiring pension is calculated at the rate of 50% of the average reckonable emoluments of last 10 Months for 33 years of qualifying service. For less than 33 years of qualifying service, the pension will be proportionately reduced.

NOTE: - The retiring pension of an officer of the rank of Lt. Col. (TS), Brigadier or Major General shall not be less than the pension which would have been admissible to him as a Major, Colonel or Brigadier as the case may be, had he not been promoted to the higher rank.

MINIMUM PENSION

W.E.F.1-1-96, minimum retiring pension is 1275/- PM

MAXIMUM PENSION
Maximum pension is Rs. 15000/- P.M. For example a General getting Rs. 30000/- pay will be entitled for Rs. 15000/- P.M. pension for 33 Years of qualifying service. For less than 33 Yrs of qualifying service, the maximum pension will be proportionately reduced.

          RETIRING PENSION TO PERMANENT ABSORBEES

The officers who had drawn lump sum payment on absorption in a PSU/Autonomous body are entitled to restoration of @ 43% commuted portion of pension after 15 Years from the date of commutation or 1-4-85 which ever is later. Along with the restoration of pension all other attendant benefits as admissible to central Govt. pensioners are also admissible.

Note: The Dearness Relief is admissible on full pension from the date of restoration, instead of Dearness Relief on only the restored amount.

PENSION TO EC/SSC OFFICERS

Serving JCOs/Ors including corresponding ranks of the NAVY & AIR FORCE granted EC/SSC will be eligible for retiring pension after 12 years of qualifying service (without weightage) actually rendered.

Note
:   ECOs/SSCOs retiring after rendering actual qualifying service of 12 years and more but less than 20 years will be granted Uniform weightage of 5 years and those retiring after rendering actual qualifying service of 20 years and more will be granted rank-wise weightage as mentioned in para-5(b)(1) of Govt. of India, Min. of  Defence  letter no. 1(6)/98/D(Pen/Sers) dated 03/02/98.

OFFICERS CASHIERED, DISMISSED, REMOVED, OR CALLED UPON TO RETIRE

: - An officer, who is cashiered or dismissed under the provisions of Army Act, is not eligible for pension or gratuity. In exceptional cases, he/she may, at the discretion of President, be granted pension/gratuity at the rate not exceeding that for which he/she would have otherwise qualified, had he/she been retired on the same date in the normal manner.

INITIATION OF PENSION CLAIM

C.D.A (O) Pune being nodal agency is responsible to collect various information/documents mentioned below and forward the same to the office of Principal C.D.A.(P), Allahabad, for grant of pension along with the documents as mentioned at IX to XI below (which is prepared by the C.D.A. (O)):-
  1. Retirement notification issued by AHQ.
  2. Certificate to the effect whether disciplinary case is pending against him or not issued from AHQrs.
  3. Unit Part II orders showing the date of S.O.S.
  4. Release Medical Board Proceedings from AHQrs.
  5. Family Details from the Army HQrs./ Officer.
  6. Pension application showing the name of any nationalised bank with single saving Bank A/C Number submitted by the officer.
  7. Commutation application given by the officer.
  8. Joint photograph duly attested submitted by officer.
  9. L.P.C. Cum data sheet.
  10. Full pay commissioned service certificate.
  11. Outstanding demand, if any, or a no demand certificate.
